Article 1 (Purpose)

These Terms set forth the rights, obligations, responsibilities, and other necessary matters between the BabyDaily operator(individual)(the "Operator") and members in relation to the use of BabyDaily and related services provided by the Operator.

Article 2 (Definitions)

The terms used in these Terms are defined as follows.

  • "Service" means BabyDaily and related services that members can use regardless of the device.
  • "Member" means a customer who accesses the Operator's Service and uses it under these Terms.
  • "ID" means a combination of letters and numbers selected by a member and approved by the Operator.
  • "Password" means a combination selected by a member to confirm identity and protect confidentiality.
  • "Post" means text, photos, videos, files, and links posted by a member while using the Service.

Article 3 (Posting and Amendment of Terms)

The Operator posts these Terms on the initial service screen or a public webpage.

The Operator may amend these Terms within the scope permitted by applicable law.

When amending these Terms, the Operator will announce the effective date and reason from 7 days before the effective date. Amendments unfavorable to members will be separately notified through electronic means.

If a member does not agree to the amended Terms, the member may terminate the service agreement.

Article 4 (Interpretation of Terms)

The Operator may establish separate terms and policies for individual services, which will prevail over these Terms in case of conflict.

Matters not specified in these Terms will be governed by applicable law and commercial practices.

Article 5 (Formation of Service Agreement)

A service agreement is formed when an applicant agrees to these Terms, applies for membership, and the Operator accepts the application.

  • The Operator may refuse acceptance if the applicant previously lost membership, uses another person's name, provides false information, is under 14 without legal guardian consent, or violates other required matters.
  • Acceptance may be withheld if service facilities are insufficient or technical issues exist.
  • The service agreement is formed when the Operator indicates completion of registration.

Article 6 (Change of Member Information)

Members may view and modify their personal information at any time through the personal information management screen.

If information entered during registration changes, members may update it in the app or request the Operator to update it by email.

The Operator is not responsible for disadvantages caused by failure to update changed information.

Article 7 (Personal Information Protection)

The Operator strives to protect members' personal information in accordance with applicable law. Personal information is governed by applicable law and the Operator's privacy policy.

Article 8 (Member Responsibility for ID and Password)

  • Members are responsible for managing their ID and password and must not allow third-party use.
  • The Operator may restrict use of an ID if it risks personal information leakage or is contrary to public morals.
  • Members must immediately notify the Operator if their ID or password is stolen or used by a third party.
  • The Operator is not responsible for disadvantages caused by failure to notify.

Article 9 (Notice to Members)

Notices to members may be made through in-service email, message, or notification service.

For notices to all members, posting on the service notice screen for at least 7 days replaces individual notice.

Article 10 (Obligations of the Operator)

  • The Operator will strive to provide the Service continuously and stably.
  • The Operator will take necessary security measures to protect personal information.
  • The Operator will establish operating procedures to handle user complaints.
  • The Operator will communicate handling results for opinions or complaints raised by members.

Article 11 (Obligations of Members)

Members must not engage in the following acts.

  • Registering false information, stealing another person's information, or altering posted information
  • Transmitting or posting unauthorized programs or information
  • Infringing copyrights or other intellectual property rights
  • Damaging the reputation or interfering with the business of the Operator or third parties
  • Publishing obscene, violent, or morally contrary content
  • Using the Service for profit or collecting data without the Operator's consent
  • Any other illegal or improper act

Article 12 (Provision of Service)

The Operator provides activity recording, data storage, diary and community, statistics and analysis, and other parenting services.

The Service is provided 24 hours a day, year-round, in principle.

The Operator may temporarily suspend the Service for maintenance or substantial operational reasons.

Article 13 (Service Changes)

The Operator may change all or part of the Service for operational or technical needs.

Free services may be modified or suspended, with no separate compensation unless required by law.

Article 14 (Information Provision)

The Operator may provide information deemed necessary for members through notices or in-app notifications.

Article 15 (Copyright in Posts)

  • Copyright in posts belongs to the author.
  • Posts may be exposed in search results and promotions within the necessary scope.
  • The Operator must obtain prior consent to use posts by any other method.

Article 16 (Management of Posts)

If a post contains content that violates applicable law, rights holders may request suspension or deletion.

The Operator may take measures for rights infringement even without a rights holder's request. Post takedown: babydaily.cs@gmail.com

Article 17 (Ownership of Rights)

Copyright and intellectual property rights in the Service belong to the Operator, excluding members' posts.

The Operator grants members only the right to use accounts, IDs, and content — members may not transfer or dispose of them.

Article 18 (Cancellation and Termination)

Members may request termination at any time through the customer center or account management menu.

Upon termination, all personally identifiable data will be destroyed immediately except where retention is required by law.

Article 19 (Use Restrictions)

  • The Operator may gradually restrict use for violations of these Terms or interference with service operation.
  • Violations of applicable law such as identity theft or hacking may result in immediate permanent suspension.
  • Members may file an objection according to procedures set by the Operator.

Article 20 (Limitation of Liability)

  • The Operator is exempt from responsibility for force majeure events.
  • The Operator is not responsible for service disruptions caused by reasons attributable to members.
  • The Operator is not responsible for reliability or accuracy of content posted by members.
  • The Operator is not responsible for use of free services unless otherwise required by law.

Article 21 (Governing Law and Jurisdiction)

Lawsuits between the Operator and members are governed by the laws of the Republic of Korea.

Disputes will be subject to the exclusive jurisdiction of the district court having jurisdiction over the member's address.

For members overseas, disputes will be subject to the jurisdiction of the Seoul Central District Court.
